Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by AI Realty Voice USA Inc. (“Company,” “we,” “us,” or “our”), including our AI-powered voice agent platform, website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

AI Realty Voice provides a subscription-based, AI-powered voice agent platform designed for real estate agents and brokerages. The Service includes automated call answering, live MLS listing lookups, lead qualification, showing scheduling, SMS confirmations, and integrations with third-party calendars and CRM tools. Features vary by subscription plan.

2. Eligibility and User Accounts

You must be at least 18 years old and legally authorized to enter into contracts in your jurisdiction to use the Service. By creating an account, you represent that all information you provide is accurate and current.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@airealtyvoice.com if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

One account may be used per licensed real estate agent or entity. You may not share accounts or resell access to the Service without our prior written consent.

3. Free Trial

New customers are eligible for a 14-day free trial upon registration. No credit card charge will occur during the trial period. At the end of the trial, your selected subscription plan will automatically begin and your payment method will be charged unless you cancel before the trial expires.

Free trials are available only once per customer. We reserve the right to modify or discontinue free trial offers at any time without notice.

4. Payment Terms and Subscriptions

The Service is offered on a subscription basis with monthly and annual billing options. All prices are stated in US dollars and are exclusive of applicable taxes unless noted.

• Monthly subscriptions are billed on the same calendar day each month. Your subscription renews automatically unless cancelled before the next billing date.
• Annual subscriptions are billed once per year in advance. Annual plans are discounted compared to monthly rates.
• Payments are processed securely through Paddle, our authorized payment processor. By subscribing, you authorize Paddle to charge your payment method on a recurring basis per your plan.
• Prices are subject to change with 30 days’ notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Cancellation Policy

You may cancel your subscription at any time through your account dashboard or by contacting us at support@airealtyvoice.com. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.

We reserve the right to suspend or terminate your account immediately for violation of these Terms, fraudulent activity, or non-payment.

6. Refunds

Refund eligibility is governed by our Refund Policy, incorporated herein by reference.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Transmit illegal, harassing, defamatory, or fraudulent content.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use the Service for any purpose other than lawful real estate business activities.
• Violate TCPA, state robocall laws, or any applicable telemarketing regulations.

You are solely responsible for ensuring your use of the Service complies with all applicable laws, including those governing recorded phone calls. Many states require all-party consent for call recordings.

8. Intellectual Property

All content, software, technology, trademarks, and materials comprising the Service are owned by or licensed to AI Realty Voice USA Inc. and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes during your subscription.

You retain ownership of data you upload or generate through your use of the Service (“Customer Data”). You grant us a limited license to process Customer Data solely as necessary to provide the Service. We do not sell Customer Data to third parties.

9. Third-Party Integrations

The Service integrates with third-party platforms including ElevenLabs (voice AI), Plivo (telephony), Google Calendar, and Paddle (payments). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or conduct of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MLS DATA WILL BE ACCURATE OR COMPLETE AT ALL TIMES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI REALTY VOICE USA INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST LEADS, OR LOST REVENUE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless AI Realty Voice USA Inc. from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings conducted in English. The arbitrator’s decision shall be final and binding.

You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
